Article 1 Scope
The terms and conditions described below detail the rights and obligations of Robert Kerr and his clients regarding the sale of products on the www.robert-kerr.com website.
All services performed by Robert Kerr SAS imply unconditional acceptance of the client to these terms and conditions.
Article 2 Products
Characteristics of the products offered for sale are presented in the “Collections” and “Product Pages” of the site. Photographs do not enter into the contract.
The responsibility of Robert Kerr can not be committed if errors occur. All text and images presented on the Robert Kerr site are reserved for the world under the copyright and intellectual property; reproduction, even partial, is strictly prohibited.
Article 3 Offer Policies
Products are available for sale while stocks last. In case of order a product that becomes unavailable, the(s) client (s) will be informed of this unavailability as soon as possible by email.
Article 4 Price
The “collections” and “product pages” on ww.robert-kerr.com site indicates prices in net euros, excluding shipping taxes. VAT is not applicable (non applicable VAT – article 293 B du CGI »). Shipping taxes will appear at the end on the screen with all products selected by the customer. The eventual customs fees, import tax and duties are charged to the customer
The Robert Kerr SAS reserves the right to change prices at any time but products ordered are charged at the current price during registration and validation of the order.
Article 5 Order Process
The customer can browse through the different products offered for sale on the www.robert-kerr.com site. The customer can browse freely through the various pages of the site without being committed to order.
The customer confirms his order when he validates the link “Checkout” page after accepting the present conditions.
The Robert Kerr SAS confirms the order by e-mail; this information covers all elements including the customer right to cancel his command.
Recorded data by Robert Kerr SAS constitute proof of the nature, content and date of the order. The client can get access to the archives by contacting the Customer Relations via email at the following address: email@example.com
Article 6 Payment process
Except server unavailability or IT failure, the customer can pay the order after final confirmation on the site by Credit Card (Carte Bleue, Visa, Mastercard only). The Client will enter his card number, expiration date, the name of the cardholder and visual cryptogram (last three numbers on the back of the credit card). Payments by checks are not accepted.
The Customer warrants that it has the required permission to use the payment method selected at the time of validation of the order. In case of rejection of the bank, the order will be automatically cancelled and the customer warned by e-mail. Data archiving for orders is made on a reliable and durable support that can be produced as evidence.
Article 7 Delivery
*Free shipping for all orders in Metropolitan France (excluding overseas departments and territories) and Countries members of the European Union (excluding Canary Islands) without minimum prices and/or quantities. International Free shipping (Excluding France and EU) for all orders equal or above 400€. For all other orders outside France and European Union below 400 €, the delivery costs are at the single price of € 25.
Items are delivered by the FEDEX Company or any other independent carrier selected by “Robert Kerr” in an average delay of 3 to 5 working days in France (including Corsica) and an average of 3-15 days outside metropolitan France as soon as the confirmation of payment is validated. These time frames are indicative. Any overrun of those times by carrier providers may in no case be used against “Robert Kerr” or lead to some compensation or refund to the customer.
The Customer must check the good condition of the product upon delivery. Any anomaly concerning the delivery (package damaged, missing items compared to the bill, late delivery etc.) will have to be notified by the customer by e-mail to firstname.lastname@example.org
In case of lack of conformity of an item delivered, the customer can return it to “Robert Kerr” at the following address: Thomas Drischel Robert Kerr SAS 17, rue Jouvenet 75016 PARIS in its original condition, accompanied by the original packaging and invoice.
Otherwise, “Robert Kerr” will not perform the exchange or refund of the defective item returned. Assuming that the return of the defective item is well-founded, “Robert Kerr” will, at the customer, or, if requested by the client, the choice of “Robert Kerr” in refund of the defective item or its exchange insofar as this item is available in stock, excluding any compensation.
Article 8 Cancelation policy
In accordance with Article L.121-21-2 of the Consumer Code, the customer has a maximum period of fourteen (14) calendar days to exercise his right of retraction, by sending e-mail to email@example.com with the reason behind the demand for withdrawal. This period starts from the date of delivery of the order.
The customer then has a maximum of fourteen (14) days to return, at his own expense the product ordered, if it does not give him satisfaction, and to cancel the order. The product must be returned in its original packaging. The return costs are under the responsibility of the Customer. Risk associated with returning the product is the charged to the Customer.
If the above conditions are satisfied, Robert Kerr will refund the customer all amounts undertaken by him at the time of ordering products except for return shipping costs. For operational reasons, the refund will be made within a period of fourteen (14) days from the date of reception of returned goods.
Article 9 : Limited Responsibility
Information of the personal data collected in connection with online sales is required; this information is necessary for the processing and delivery of orders and for issuing invoices. This information is strictly confidential. The lack of information implies the automatic rejection of the order. According to the law n ° 78-17 of 6 January 1978 relating to data processing, the processing of personal information collected on the website has been declared to the National Commission for ‘Computing and Liberties, registered under notification number (in progress). The Customer has a right of access, modification, rectification and deletion of data. To exercise this right, the customer must send an email to firstname.lastname@example.org
Article 10 : Litigation
French law governs the present General conditions of sales and the contractual relations between the parties. Any dispute arising from the application or interpretation of the Terms and Conditions is under the exclusive competence of the courts of Paris.
Article 11 : Force Majeure
Robert Kerr can not be held responsible for the full or partial non-performance of its obligations, if non-performance is due to unforeseeable circumstances or the occurrence of an element of force majeure as including, without this list not limited to, flood, fire, storm, lack of raw materials, transport strike, or partial strike or lockout. These events are a cause for suspension and / or termination of obligations of the customer to Robert Kerr, without compensation to the Client.
